Terms of Service

These Terms of Service ("Terms") govern your use of Octopush ("the App", "we", "us"), a desktop application for macOS operated by Octopush. By downloading, installing, or using the App you agree to these Terms.
1. The service
Octopush is a native desktop IDE for agentic software development. A free tier runs locally and uses your own third-party AI provider keys ("bring your own keys"). An optional paid subscription ("Premium") unlocks additional capabilities such as multi-agent orchestration. Features and limits are described on our website and may evolve over time.
2. Accounts
Some features require an account. You are responsible for the accuracy of your account information and for activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a subscription.
3. Subscriptions and billing
Premium is billed on a recurring subscription basis through our authorized reseller and Merchant of Record, Dodo Payments, which handles payment processing, billing, and applicable taxes. By subscribing you authorize the recurring charge until you cancel. Prices are shown at checkout. See our Refund & Cancellation Policy.
4. Bring your own keys
When you use your own AI provider credentials (for example Anthropic, OpenAI, DeepSeek, or a local model), you are solely responsible for those accounts, for any usage charges they incur, and for complying with the provider's terms. The App helps you observe and budget token usage, but estimates are informational and are not a guarantee of provider billing.
5. Acceptable use
You agree not to misuse the App, including to (a) violate any law or third-party right, (b) reverse engineer or circumvent license or entitlement checks except as permitted by law, (c) resell or redistribute the App without permission, or (d) use it to generate or facilitate harmful, infringing, or illegal content.
6. Intellectual property
The App, its design, and its content are owned by Octopush and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the App in accordance with these Terms. You retain all rights to the code and content you create with it.
7. Disclaimers
The App is provided "as is" without warranties of any kind, to the maximum extent permitted by law. AI output may be inaccurate; you are responsible for reviewing any code or changes the App proposes before relying on them.
8. Limitation of liability
To the maximum extent permitted by law, Octopush will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or third-party provider costs, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
9. Termination
You may stop using the App at any time and cancel your subscription as described in the Refund & Cancellation Policy. We may suspend or terminate access for a material breach of these Terms.
10. Changes
We may update these Terms. Material changes will be reflected by updating the effective date above and, where appropriate, by notice. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Colombia, without regard to conflict-of-laws rules.
